When a person is suddenly and unexpectedly arrested by the police on the suspicion of a sex offense, there is a knee jerk tendency across America today to presume guilt.  We have represented individuals who have been falsely accused of rape and other sex crimes in Ohio. 

Unfortunately, too many of these alleged crimes are based exclusively upon the word of the alleged victim and cannot be corroborated in any way by objective medical evidence, witnesses, or other objective evidence.  In essence, the accused must prove a negative - that the alleged crime did not happen.

We have learned that there are a range of motives for alleged victims to concoct a story. 

Many of these victims have flimsy and ever-changing stories, refuse to take a polygraph, or have pre-existing mental health issues that compromise their credibility. Unfortunately, the accused in a sex case is always at a chronic disadvantage due to "Rape Shield" Laws that protect the victim in many ways. 

Also, if the alleged victim is a child, the defense attorney's job is now even tougher due to our innate instinct to protect children.  Every defense lawyer involved in a child sex case must reconcile in his or her own mind how best to approach false sex abuse allegations involving a child.  Not only are the allegations generally potent, they tend to propped up by medical experts who may be making faulty diagnoses.  Two commonly attacked theories are Munchausen by Proxy and Repressed Memories.
