4th or 5th Offense Ohio DUI in 6 Years (4th Degree Felony)

60 days jail (120 days if a "Refusal") - 1 year Prison OR 60 days Prison + Optional 6 mos. - 30 mos.

$800 - $10,000 Fine

Mandatory Alcohol Treatment

3 Years to Lifetime License Suspension

No Driving Privileges for First 3 Years (then only with "interlock" and yellow plates)

Mandatory Forfeiture of Vehicle (if registered to defendant)

 

2d Lifetime Felony Ohio DUI (3rd Degree Felony)

60 days Prison - 5 Years

$800 - $10,000 Fine

3 Years to Lifetime License Suspension

Mandatory Forfeiture of Vehicle (if registered to defendant)

 

6th Offense Ohio DUI in 20 Years ("6 in 20 Specification")

R.C. 2941.1413 provides for a mandatory definite prison sentence of 1, 2, 3, 4, or 5 years plus all the other penalties stated above.  NOTE: this prison sentence must run concurrent to the other jail / prison imposed by the trial court.
