Nurses, Doctors & Rx Theft

You are here: Home | Ohio Criminal Defense | Nurses, Doctors & Rx Theft

When a doctor or nurse diverts narcotics from a hospital's Pyxis or other drug distribution network, the consequences are immediate and can be severe.  Typically, when the professional is caught, the medical facility will initiate an emergency protocol to ensure patient safety was not compromised and to determine the full extent of the theft.

It is not unusal for the doctor or nurse to confess to the hospital security and medical director.  At that point, termination is normally the only option for the hospital.  Notification of the crime to the medical board or nursing board is next. Finally, local law enforcement is alerted and a criminal investigation is initiated.

It is advisable for the doctor or nurse to immedidately enroll in counseling, attend NA, obtain a sponsor, and retain a lawyer.  Eventually, felony charges will brought.  Criminal prosecution could take months and the potential legal consequences range from Intervention in Lieu of Conviction, Diversion, Community Control sanctions (i.e. probation), or prison.

Representing the impaired professional takes an understanding in the nuances of chemical dependency so that the case can be properly presented to the county prosecutor's office in mitigation of penalties.

If you or someone you know is addicted to narcotics and is employed in the medical field, please feel free to contact Attorney Brad Koffel for a private consultation.  You may reach Mr. Koffel directly at 614-481-7215.
