Due to the fact Ohio has over 30 legal limits based upon age, type of bodily fluid tested, whether or not drugs were analyzed, and whether or not there was a refusal of the chemical test, we are not comfortable publishing "sentencing charts".

 

Quite frankly, Ohio DUI / Ohio OVI sentencing matrixes are too complex unless you are a first time DUI offender and did not test over the "Super DUI limit".

When you e-mail, please use the following guidelines to frame your question.

First, is this a "REFUSAL"of a chemical test? [SKIP THE NEXT QUESTION]

Second, what is the TEST RESULT and WHAT WAS TESTED (breath, urine, blood serum, or whole blood?)

Third, what is the person's DUI RECORD? NOTE: IF THE CASE WAS CHARGED UNDER COLUMBUS OHIO CITY CODE, THERE IS A LIFETIME LOOK BACK PERIOD. ALSO, MAKE SURE TO INCLUDE PRIOR DUI'S IN OTHER STATES.

1st offense in 6 years, with at least one prior outside 6 years but within past 20 years

2d offense in 6 years with no priors outside 6 years

2d offense with no priors in 6 years but at least one prior within 20 years

3rd offense in 6 years with no priors outside 6 years

3rd offense in 6 years with priors outside 6 years

3rd offense in 20 years but none in past 6 years

3rd offense in 20 years with no priors in 6 years

4th offense in 6 years but no priors outside 6 years

4th offense in 6 years with priors outside 6 years

4th offense in 20 years but none in the past 6 years
