Koffel & Jump Attorney Discovers Major Breath Test Issue

Koffel & Jump Partner Tod Brininger discovers the destruction of calibration records in Licking County, Ohio. Breath tests called into question

Attorney Tod Brininger, a Partner in our DUI / Criminal Defense Group, had a Licking County Ohio Sheriffs deputy on the witness stand during a routine breath test suppression hearing. Under cross-examination by Mr. Brininger, the deputy admitted that he destroyed evidence of calibration problems with Licking County's main breath test machine - a BAC DataMaster.

As a result of this surprising testimony, the judge had very little choice but to suppress our client's breath test. Now, months later, this information is reaching national news outlets, including CNN and USA Today. At this point, it is unclear how many Licking County Ohio DUI cases are in jeopardy.
